Terms and Conditions

Welcome to Click Spikes! We provide our services to you subject to the following Terms of Service, which you acknowledge, agree to, and consent to by using our HRM system. These Terms apply to all visitors, users, and others who access or use the Service.

1. Acceptance of Terms

By accessing or using our HRM system, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the service.

2. Service Description

Click Spikes provides a comprehensive HRM system designed to facilitate human resources management including recruitment, employee management, payroll processing, performance evaluations, and more. Our service is provided "as is" and is subject to system updates and maintenance.

3. User Accounts

To access and use certain features of the service, you must register for an account. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password.

4. Privacy Policy

Our Privacy Policy, which describes how we handle data you provide to us, is part of these Terms. You agree to the collection, use, and sharing of your data in accordance with our Privacy Policy.

5. Modifications to the Service and Prices

Click Spikes reserves the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. Prices of all services are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to our HRM system site.

6. Copyright and Trademarks

The service and its original content, features, and functionality are and will remain the exclusive property of Click Spikes and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Click Spikes.

7. Termination

We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ontario, without regard to its conflict of law provisions.

9. Use of the Service

  1. The User shall use the Service solely for personal, internal business purposes and not for any commercial or public use.
  2. The User agrees to comply with all applicable laws, regulations, and guidelines when accessing or using the Service.
  3. The User is responsible for ensuring that their User Account information is accurate, up-to-date, and secure.
  4. The User shall not: i. Use the Service for any illegal or unlawful purpose. ii. Hack, crack, or attempt to gain unauthorized access to the System or any other user's account. iii. Post, upload, or transmit any content that violates the intellectual property rights of others. iv. Engage in any form of spamming or phishing activity.
  5. The User shall not use the Service for any purpose that is harmful, offensive, or illegal.

10. Administrator Rights

a. The Admin has the right to manage and control access to the System, including adding, removing, or modifying User Accounts. b. The Admin may also set policies and rules governing the use of the System by Users. c. The Admin shall be responsible for ensuring that all Users are aware of and comply with these Terms.

11. Confidentiality

a. All information exchanged between the User and the System, including any personal data or confidential information, is considered confidential. b. The User agrees to keep all such information confidential and not disclose it to anyone else. c. The System shall take reasonable measures to protect the confidentiality of the User's information.

12. Intellectual Property

a. All intellectual property rights in the Service, including patents, copyrights, trademarks, and trade secrets, are owned by Click Spikes. b. The User agrees not to reproduce, modify, or distribute any content or materials provided through the Service without prior written consent.

13. Warranty Disclaimer

The Service is provided "as-is" and "as-available." We disclaim all warranties, express or implied, including but not limited to:

a. Warranty of merchantability.
b. Warranty of fitness for a particular purpose.
c. Warranty of non-infringement.
d. Warranty of title.

14.Limitation of Liability

In no event shall Click Spikes be liable for any damages, losses, or claims arising out of or related to: a. Use or inability to use the Service. b. Content provided through the Service. c. Errors or omissions in the Service. The maximum aggregate liability of Click Spikes under these Terms shall not exceed

15. Entire Agreement

These Terms constitute the entire agreement between you and us regarding your use of the Service and supersede all prior or contemporaneous agreements, whether written or oral.

16. Amendments

As a software company we are a number of employees and my task was to find a solution not to make one for our HR and Payroll system. After a quick search and recommendation from one of my friend I started drilling this tool. After testing it I hand overed it our HR team. The first comment I received was this is so user friendly and easy to manage system. When my team is happy I am happy.
